Without going into merits of the case and by consent of parties, the impugned orders to the extent that it decides the admissibility of document at serial no.4 can be remanded to the trial Court to be decided afresh.

Learned counsel appearing for the respective parties submit that the evidence as well as objections of the respondent as regards the admissibility of document at serial no.4 is already placed on record. The trial Court is directed to decide the objection as regards Patil-SR 1 of

Needless to clarify that the admissibility has to be decided by taking into consideration the written submissions of both the parties. 5.

Trial Court is requested to pass a reasoned order giving reasons as to its decision on the admissibility of document at serial no.4.
