Suraj Samat v. The State Of Maharashtra
wp-4166-16-(33)
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 4166 OF 2016 Suraj Samat ..Petitioner Vs.
State of Maharashtra ..Respondent Mr. Sunny Punamiya for the Petitioner Mr. J. P. Yagnik Addl. PP for the Respondent State CORAM :R. M. SAVANT, & SANDEEP K. SHINDE, JJ DATE : 7th AUGUST, 2017 P.C.
The Learned Additional P. P. has drawn our attention to the report dated 7-8-2017 of the Senior Inspector of Police, Khar Police Station, Mumbai. The said report inter alia contains the steps that the police have taken in the matter of investigation. The said report refers to the notices issued under Section 91 of the Cr. P.C. for production of documents by the respective persons.
Having regard to the said report, the contention of the Learned Counsel for the Petitioner that the police have not carried out any investigation pursuant to the registration of the FIR does not stand to reason. In fact a Division Bench of this Court in its order dated 14-3-2017 has recorded the statement of the Learned Additional P.P. that pursuant to the FIR, the mmj
wp-4166-16-(33) investigation is in progress. In view thereof, it is not necessary to issue any directions of the nature sought by the Petitioner in the above Criminal Writ Petition. The above Criminal Writ Petition is accordingly dismissed. However, it is expected of the police that they would file the report under Section 173 with reasonable dispatch. [SANDEEP. K. SHINDE, J] [R.M.SAVANT, J] mmj
