Heard Mr. Dighe, learned counsel for the applicant. He draws attention of this Court on the order dated 30th June, 2020 passed by the Additional Sessions Judge, Nashik directing the release of Mr. Suraj Prakash Shah, Chairman of Credit Co-operative Society. According to Mr. Dighe, the allegations against the said accused, who happens to be Chairman of the Credit Co-operative Society are almost at par or more serious. According to him, the said order was not available when the applicant has moved for grant of regular bail. He submits that the applicant is behind bar since 2018 and that being so, opportunity may be granted to approach before the Sessions Court.

Ms. Sharmila Kaushik, learned APP submits that in the facts and circumstances of the case appropriate order may be passed. 3.

In view of subsequent development of release of the applicant/accused Suraj Shah, who was Chairman of the Society, where the applicant worked as Manager, it will be appropriate, in my opinion, to approach the Sessions Court afresh. As such, the application stands disposed of with liberty to approach before the Sessions Court, in view of above subsequent development.
