The grievance of the Petitioner is that even when he had secured marks higher than the last candidate in the written examination, he was not being permitted to face the interview. It was stated that the Petitioner had secured 109 marks as against 108 obtained by the last candidate in the written examination. Based upon this plea, by virtue of an interim order dated 07th January, 2023, we had permitted the Petitioner to participate in the interview process with the condition that his result would not be declared except when ordered by this Court. 42 WP.14842.2022 AS.doc The Petitioner having faced the interview, the result was prepared and was brought before us today in a sealed cover, which reflects that as against 144 marks obtained by the last candidate recommended by the Maharashtra Public Service Commission (MPSC), the Petitioner secured only 133 marks in total, including the 24 marks obtained by him during the interview process. In that view of the matter, learned Counsel for the Petitioner seeks leave to withdraw the present petition. The petition is disposed of as withdrawn.
