On instructions, Mr Godbole seeks leave to withdraw the Petition. The Petition is dismissed as withdrawn with the clarification that the RAE&R Suit No.726/1127 of 2003 filed by the Petitioner, Dadajee Dhackjee Pvt Ltd, against Hickson and Dadajee Pvt Ltd., will proceed unaffected by the amendment permitted in the present TE&R Suit No.235/254 of 2003. In other words, the allowing of the amendment in TE&R Suit No.235/254 of 2003 will not prejudice the merits of the Petitioner's RAE&R Suit No.726/1127 of 2003. 21st November 2017
