DATE: 05 JANUARY 2015 P.C. :- 1] Heard Mr. Dalvi for the petitioners and Mr. Hakani for respondent nos. 5 and 6, who are the contesting respondents. 2] The controversy raised in this petition can be settled in view of the agreement arrived at between the parties in the following terms:
(A) Respondent nos. 5 and 6 have already filed before the Divisional Joint Registrar written arguments-cum-notes to the revision application no. 4 of 2013 and a copy of the same has been furnished to the petitioners. Such written arguments shall be taken into consideration by the learned 1/2
skc 12-WP-11637-14 Joint Registrar and in view of the same there shall be no question of respondent nos. 5 and 6 either themselves or through their advocates making any further submissions in revision application no. 4 of 2013.
(B) In view of the aforesaid, the learned counsel for the petitioners, without prejudice to his contentions that the Divisional Joint Registrar, has no powers to permit intervention, does not press the present petition. 3] Accordingly, this petition is disposed of in the aforesaid terms. The Divisional Joint Registrar to dispose of the revision application no. 4 of 2013 on its own merits and in accordance with law, as far as possible within a period of four weeks from today. 4] Mr. Hakani, the learned counsel for respondent nos. 5 and 6 to intimate the substance of this order to respondent nos. 5 and 6 particularly since the matter is posted for hearing before the Joint Registrar, today.
