In this case vide order dated 5.12.2022, by PRADIPKUMAR PRAKASHRAO DESHMANE Date:

2022.12.21 10:51:02 +0530 PRADIPKUMAR PRAKASHRAO DESHMANE directions were issued to add the appeal on the weekly final hearing board commencing from 9.1.2023.

During the course of arguments it was noticed that in many cases hearing of the appeals, for various reasons, were expedited, but, those appeals are not listed on the board. In many cases, the appellants crossed the age of becoming Senior Citizens during pendency of the appeals. Deshmane(PS)

Therefore, some mechanism was necessary to process those appeals in the category of the appellants who were Senior Citizens. On both these issues, I had called a report from the Registry.

Accordingly the Assistant Registrar (Criminal Appeal Branch) has tendered a report dated 16.12.2022, which is as under :

"This pertains to report called for by Your Lordship in Interim Application No. 3992 of 2022 in Criminal Appeal No. 133 of 2014 regarding what practice is followed by Registry concerning the cases of Senior Citizen and wherein Order expediting hearing of Appeals is passed.

In this regard, it is respectfully submitted that the Appeals wherein Order to expedite the hearing of the matter is passed, registry take steps to make ready the Appeals for final hearing. The said matters are taken on final hearing board under caption of "Expedite Hearing" & are being placed before the Court as per directions.

Registry follows the practice that in Appeals, when the Appellants crosses the age of becoming Senior Citizen during pendency of Appeals, in such cases, if his Advocate forward praecipe to Registry informing that his Client / Appellant or Respondent

has crossed age of becoming Senior Citizens, then the Registry take a note in the system as matter of Senior Citizen and place it on final hearing board under caption of Senior Citizen as per directions of the Hon'ble Court."

These issues are important and the litigants need to know about the Registry'

s procedure in that behalf.

Therefore, the Registry shall take steps including publishing this on the Website of this Court; so that the litigants are aware of this procedure.

The application is disposed of accordingly.
