IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.33/2018 WITH CIVIL APPLICATION NO.956/2018 Shankar Rabhaji Shinde & Ors.
... Petitioners V/s.
Arvind Janardan Kulkarni & Ors.
... Respondents Mr. Sushil Inamdar for the Petitioners
CORAM:
K.K. TATED, J.
DATED :
JANUARY 8, 2019 P.C. :
Heard. By this petition under Article 227 of the Constitution of India, the Petitioner challenges the order dated 23.10.2017 passed by the Bombay City Civil Court, Mumbai in Notice of Motion No.2684/2017.
The learned counsel for the Petitioner submits that the matter is settled out of court. The parties have filed Consent Terms in S.C.Suit No.10058/1991. Hence, nothing survives in the Writ Petition.
In view of these facts, the Writ Petition stands disposed of as infructuous.
Consequently Civil Application does not survive. Same stands dismissed as infructuous.
