1] Heard learned counsel for the Applicant and learned counsel for the Respondent.

2] This is a transfer application filed under Section 24 of the Civil Procedure Code. The Respondent, herein, has filed Marriage Petition No.1246 of 2016 against the Applicant for Restitution of Conjugal Rights under Section 9 of the Hindu Marriage Act, 1955, in the Court of Civil Judge, Senior Division at Kalyan. The Applicant is the resident of Dafalapur, Taluka-Jath, District Sangli. Naturally, the Applicant is finding it very inconvenient to travel from Dafalapur to Kalyan, which is a distance of about more than 450 k.m.. 1/2

osk 42-mca-30-2018.odt 3] Hence, taking into consideration the fact that the Applicant is a lady and she can not travel alone and she is finding it difficult to travel alone such a long distance, having no arrangement for stay at Kalyan, the Application for transfer of the proceeding is allowed. Hindu Marriage Petition No.1246 of 2016 is transfered accordingly from the Court of Civil Judge, Senior Division, Kalyan to Court of Civil Judge, Senior Division, Sangli, which is also having jurisdiction to entertain and try the petition. 4] Both the parties are accordingly directed to appear before the Court of Civil Judge, Senior Division, Sangli, on 24th July, 2018. 5] Registry is directed to inform the concerned Courts about this order and do the needful.
