CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 4338 OF 2015 IN FIRST APPEAL NO. 295 OF 2013 Office Notes, Office Memorandum of Coram appearance, Court's orders or directions Court's or Judge's Orders. and Registrar's Orders.
Coram : R.M. Joshi Registrar (Judl.-II) 23rd December, 2015.
In this application, the Hon'ble Court had directed Appellant to furnish postal stamp for effecting service in respect of Respondent Nos. 4, 5, 7 and 8. After the stamps were supplied, notices were issued to these respondents through R.P.A.D. and the same have been returned with a remark "Not claimed". The said service was not accepted to be good service. The Appellant has stated on oath that they tried to ascertain address of the unserved respondent but could not find the same. The Appellants are now seeking publication of the notice in news paper "Prabhat" circulated in the area of Pune.
- 2 - In view of the fact that the notices have been returned with a remark "unclaimed" there is reason to believe these respondents are avoiding the service of notice, hence Civil Application is allowed. Notice is returnable within 8 weeks.
