By this first appeal, appellant/claimants are challenging judgment and award dated 19.4.2016 passed by Railway claim Tribunal, Mumbai Bench, Mumbai in Application O.A. No.(IIu)MCC/2010/0630 by which appellant's claim petition stands rejected.

Considering the submissions made by learned counsel for appellant and impugned judgment and award, I am satisfied that appellant has made out a case for following order.

a) Admit.

b) Printing dispensed with.

c) The Appellant is directed to file private paper book within one year from today, with copy to other side, failing which the First Appeal shall stand dismissed without further reference to the court.

d) Registry is directed to call record and proceeding immediately.

e) Hearing of first appeal is expedited.

f) Liberty granted to appellant to move before this Court for fixing early date of hearing, as soon as record and proceeding is received and paper book filed.
