Ms. Deokar, learned counsel for the applicant (original respondent no.1) seeks extension of time to enable the learned Joint Civil Judge, Senior Division, Thane to dispose off the suit within the extended period. She states that the evidence of the parties has not been commenced. Legal heirs of the defendant no.1 are not brought on record before the Trial Judge. Statement is accepted. 2.

Both the parties are directed to co-operate with each other and the learned Joint Civil Judge, Senior Division, Thane to dispose off the suit within the extended period. If any party seeks any unnecessary adjournment, Trial Judge to record such facts in the roznama.

Time to dispose off the suit is extended by six months from 1st November 2022. Parties are directed to communicate this order to the learned Judge for information and compliance. Learned Advocate for the defendant no.1 before the Trial Judge to communicate the names of the legal heirs of the defendant no.1 to the learned counsel for the plaintiff within one week from today.
