Learned advocate appearing for the applicant, on instructions, seeks permission to withdraw this application with liberty to prefer an application for bail before the Sessions Court. It is submitted that the applicant had preferred an application for bail before the Sessions Court, Thane, which was rejected on 30th January, 2018. Thereafter charge-sheet was filed against the applicant in February 2018. It is further submitted that in pursuant to the rejection of the application vide order dated 30th

rpa 2/2 505-ba-2860-18.doc January, 2018, the applicant has not preferred any application for bail before the Sessions Court and he has moved this Court by preferring this application. Due to filing of charge-sheet and considering the fact that two other accused are granted bail by the Sessions Court, the applicant intends to prefer a fresh application for bail before the Sessions Court. In view of the aforesaid submission, this Bail Application is allowed to be withdrawn with liberty to prefer an application before the Sessions Court. Bail Application stands disposed of, as withdrawn.
