The applicant is seeking pre-arest bail in Crime No. 437 of 2015, registered with Shivaji Nagar, Mumbai Police Station, for the offence punishable under Section 420 Indian Penal Code, in which the charge-sheet is already filed against the husband of the applicant.

The transaction which is found to be a basis for registration of crime is in the background of assurance for transfer of the immovable commercial property.

Dusane 2/2 aba2086.2016 The main accused i.e. husband of the applicant is already arrested.

The role attributed to the present applicant cannot be inferred to be of having actually participated in the crime in question. Hence, in the event of arrest, the applicant be released on P.R. Bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with one or two sureties in the like amount.

The applicant to attend Shivaji Nagar, Mumbai Police Station as and when called.

The applicant not to tamper with the evidence and/ or influence the witnesses in any manner whatsoever. (N.W. SAMBRE, J.)
