Heard the learned counsel for the parties.
This application is for bringing legal heirs on record of deceased respondent no.1 Laxmibai Waman Rajguru who expired on 10.8.2015.
Advocate for the applicant submits that legal heirs of deceased respondent no.1 are already on record as stated in paragraph 4 of the Civil Application.
Considering the submissions made by the learned counsel for the Applicant and the Mohite 1/2
5 caw3256-15 averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:
a) Delay in preferring the Civil Application is condoned.
b) Applicant is permitted to bring legal heirs on record as stated in paragraph 4 of the Civil Application.
c) Amendment be carried out within four weeks from today, failing which Civil Application shall stand dismissed without referring back to the court.
d) If amendment is carried out within stipulated time as stated hereinabove, applicant is permitted to serve amended copy of petition on respondent or their advocate thereafter.
