P.C.:- At the outset, the learned APP, on instructions, submitted that the trial of the present case has already commenced and the prosecution has examined seven witnesses as of today and is intending to examine approximately 10 to 12 more witnesses in support of its case.
The learned counsel for the Applicant submitted that according to his information, the prosecution has examined only five witnesses as of today. However, he is not seriously disputing the claim of the prosecution.
As the trial of the present case is already commenced, at 1/2
ssm 2 918-ba2679.17.sxw this stage, I am not inclined to release the Applicant on bail and the Applicant is granted liberty to file a fresh Application for bail before the Trial Court, if the trial arising out of CR No. 169 of 2003 dated 15th August, 2003 registered with Mira Road Police Station, District Thane, now culminated into the Sessions Case No. 29 of 2013 does not conclude within a period of six months from today. Leave and liberty granted.
Application is disposed of as withdrawn, with aforesaid liberty.
