Heard learned counsel for the Applicant.

The Applicant is challenging the concurrent finding and order of the Trial Court and Appellate Court holding him guilty for the offence punishable under Section 138 of Negotiable Instruments Act. As per the said order, he is directed to pay compensation of Rs.2,25,000/-. He has already deposited the amount of Rs.56,250/- and now he is ready to deposit further amount of Rs.75,000/-.

In view thereof, the substantive sentence of imprisonment imposed on the Applicant deserves to be suspended. Subject to deposit of further amount of Rs.75,000/- in the Trial Court, the relief in terms of prayer 1/2 APPR-487-15==.doc
clause (b) is granted and substantive sentence of imprisonment imposed on the Applicant is suspended. Applicant be released on execution of fresh P.R. Bond of Rs.10,000/-, with one or two sureties in the like amount.
