This is an application for modification of condition imposed upon the applicant while releasing him on bail by order dated 27-09-2012. The applicant was directed to surrender his passport to the Investigating Agency within a period of one week from 27-09-2012. It appears that the applicant thereafter moved an application for modification of the said condition and this Court by its order dated 30-07-2014 allowed the applicant to make an application before the learned Magistrate who is seized of the matter for the return of the passport. 20-appp-838-2014 observed by this Court that the applicant did not have any plan to depart from the Country immediately.

In pursuance of said liberty granted by an order dated 31-07-2014 and the applicant moved an application for return of passport on 13-08-2014 before the learned Magistrate. The learned Magistrate by its order dated 17-112014 rejected the said application on the ground that the applicant has no plan to travel abroad. As no grounds were made out to return of the pass-port, the said application was rejected.

The present application is filed on 10th December 2014 the applicant has not mentioned any reason nor has given any itinerary to travel abroad and therefore, return of passport to the applicant is not warranted at this stage. I find no error in the order passed by the learned Magistrate dated 17-11-2014. Present application in devoid of any merits and is dismissed accordingly.
