This is an application under Section 439 of the Code of Criminal Procedure, 1973 for bail.

The applicant came to be arrested in Crime No. 157 of 2022 registered at Talegaon Dabhade Police Station, Pimpri Chinchwad for the ofences punishable under Sections 395, 506 of Indian Penal Code, Sections 4 read with 25 of the Arms Act and Sections 37(1)(3) read with 135 of the Maharashtra Police Act. 3.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State.

The bail is sought on the ground of parity. In support of the said ground, the learned counsel for the applicant has placed on record the copy of order passed by this Court dated 25 January 2023 in Bail Application No. 3068 of 2022 as well as copy of the 1/2

910-ba-3459-22.doc order passed by the Sessions Court dated 5 September 2022 in Criminal Bail Application No. 445 of 2022. By the said orders, the co-accused Sanjay Chavan, Ganesh Kale, Amrut Jadhav and Vishal Vasudev Sonavane are released on bail.

I have perused the charge-sheet. The role attributed to the present applicant and the co-accused Sanjay Chavan, Ganesh Kale, Amrut Jadhav and Vishal Vasudev Sonavane appears to be identical. Considering this fact and as there are no other criminal antecedents, I am inclined to release the applicants on bail. Hence, the following order is passed:

ORDER

(i) Application is allowed.

(ii) The applicant be released on bail in Crime No. 157 of 2022 registered at Talegaon Dabhade Police Station, Pimpri Chinchwad for the ofences punishable under Sections 395, 506 of Indian Penal Code, Sections 4 read with 25 of the Arms Act and Sections 37(1)(3) read with 135 of the Maharashtra Police Act on furnishing PR bond in the sum of Rs. 30,000/- with one or two sureties in the like amount. (iii) The applicant shall attend the concerned police station once in a month i.e., on frst Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.
