P.C.:- This is an Application for relaxation of condition Nos. (iii) and (iv) imposed upon the Applicant while releasing him on bail, by this Court, by its Order dated 24th January, 2018. The learned counsel appearing for the Applicant submitted that, till date the Investigating Agency has not completed investigation and charge-sheet has not been filed, and therefore, the said condition of not to reside in Indapur may be modified.

The learned APP, on instructions from the Investigating Officer, submitted that the charge-sheet as against the present 1/2

ssm 2 917-appp1357.18.doc Applicant in the present crime, will be submitted within 8 days from today. The said statement is accepted.

Even otherwise, the record indicates that, after taking into consideration the attending circumstance of the present case wherein an offence under Section 326 of the Indian Penal Code against the Applicant is alleged and therefore, this Court by its Order dated 24th January, 2018 has imposed the said condition. In view thereof, I find no reason to modify the said condition.

Application is accordingly rejected.
