Petitioner, a defeated candidate in the election fought against respondent no.2, seeks direction to respondent no.1-Corporation to refer the issue of dis-qualification of respondent no.2 to the judge as contemplated under Section 12 of the Maharashtra Municipal Corporation Act, 1949.

Learned counsel appearing for the Corporation submits that the Commissioner had already submitted a report to the General Body in respect of the subject matter of the petitioner. The General Body is seized of the matter.
