The learned counsel for the Applicant submits that though today none present for Respondent No. 2 but the appearance is filed by on behalf of Respondent No. 2 before the Division Bench when the matter was appeared. He submits that there is delay of 25 days in filing the First Appeal. He submits that the Appellant is staying at London and therefore it took time to coordinate things with him and file the Appeal.

The learned counsel for the Respondent No. 1 opposes the Application.

In view of the submissions made by the learned counsel for the Applicant and the reasons mentioned in the application at para Nos. 2 and 3, the delay is hereby condoned. The First Appeal be registered.
