Perused records. It appears that Notice issued through Bailiff to Respondent No.3 returned unserved with remark "Left the premises and present address not known".

Moreover, Notice issued through "R.P.A.D." to Respondent No.3 returned unserved with postal remark "Left".

The address mentioned in above notices is same address mentioned in Appeal Memo and in Judgment of the Court of M.A.C.T. Mumbai. This affirmed substitute to allow the Application regarding substitute service of Respondent No.3 by

way of Publication in Newspaper namely "Free Press Journal" and "Navshakti".

In view of this, Civil Application for Publication is allowed in terms of prayer clause (a) against Respondent No.3, returnable within 6 weeks.
