Learned counsel for the petitioner seeks to withdraw this petition with liberty to file an appeal before the Grievance Redressal Committee constituted by the State Government under Section 35(1A) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 within two weeks from today. Statement is accepted.

Papers and proceedings of such appeal shall be served upon the respondents simultaneously. If any application for condonation of delay is made by the petitioner before the Appellate Authority, in view of the fact that the petitioner was pursuing this petition in this Court in good faith and with due diligence, the Appellate Authority shall condone delay if appeal is filed within two weeks from today.

Writ petition is dismissed as withdrawn with liberty as prayed with aforesaid directions. Parties to act on the authenticated copy of this order.
