Heard the learned counsel for the applicant and the learned APP for the State.

This application is preferred seeking pre-arrest bail in connection with C.R. No. 642 of 2023 registered at Yerwada police station for the offences punishable under sections 383 and 499 read with 34 of Indian penal Code, 1860.

The learned counsel for the applicants submitted that the applicants have preferred an application for pre-arrest bail before the Court of Session on 24th September, 2023 and application is now posted for hearing on 3rd November, 2023. The application for interim bail (Exhibit 4A) is also not yet decided. 4.

The learned APP, on the instructions of the investigating officer, who is present in Court, submits that since the application is Vishal Parekar ...1

19-aba-3026-2023.doc now listed on 3rd November, 2023, before the Court of Session, the investigating officer would not arrest the applicant till the Court of Session decides the application for pre arrest bail. 5.

The learned Additional Session Judge is requested to make an endavour to decide the application as expeditiously as possible and if it is not possible to decide the main application, interim application for pre arrest bail (Exhibit 4A) be considered and decided on priority.
