This is an application under Section 438 Cr.P.C. filed by the aforesaid applicant apprehending his arrest in C.R.No. 367 of 2022 registered with Jejuri Police Station, Pune for offences under Section 326, 504, 526 r/w. 34 of the Indian Penal Code. 2.

Heard Mr. Mishra, learned Counsel for the applicant and Mr. Patil, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties . 3.

The aforesaid crime was registered pursuant to the FIR lodged by Aniket Indalkar. He has alleged that on 31.10.2022 the applicant and one unknown person came to his petrol pump and gave him blows of Digitally signed by PRASANNA P SALGAONKAR Date:

fractured. The material on record does not prima facie indicate that the injury was caused by means of a dangerous weapon, or any other weapon or instrument as specified in Section 326 of the IPC. Prima facie the allegations would constitute offence under Section 325 of IPC, which is bailable.

Considering the above facts and circumstances, in my considered view, the applicant would be entitled for bail. Hence the order:- (i) In the event of arrest of the applicant in Crime No.367 of 2022, registered with Jejuri Police Station, Pune, the applicant be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand Only) with one or two sureties in the like amount, to the satisfaction of the Investigation Officer.

(ii) The applicant shall report to the Investigating Officer as and when required by the Investigating Officer for the purpose of investigation and interrogation.

(iii) The applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer. (iv) The applicant shall not change his residential address without prior

intimation to the Investigation Officer.

(v) The applicant shall not interfere with the complainant and the other witnesses in any manner.
