This is an application seeking return of an amount of Rs. 1,00,000/- deposited by the applicant-accused voluntarily at the time of granting of bail by this Court on 17th October, 2012. Para 5 of the said order reads thus;
"5 In view of the allegation with respect to the offence punishable under section 406 of the IPC, the learned advocate for the applicant submits that the applicant is ready to deposit an amount of Rs.1,00,000/- with the Investigating Agency for securing the alleged loss of her property by the First Informant. He also submits that the applicant is ready to abide by any other conditions, as may be imposed by the Court, while releasing him on bail." 28-APPP-1369-2018.doc It is apparent from the said order that the applicant voluntarily deposited Rs.1,00,000/- with the Investigating Agency for securing the alleged loss of the property. There was no direction by this Court to deposit an amount of Rs.1,00,000/-. It appears that the applicant has been acquitted by the trial Court on 5th July, 2018 as none of the charges could be proved since the victim didn't support the case of the prosecution. In view of the above, the application does not have any merit and hence, dismissed.
Liberty to the applicant to prosecute his remedy in accordance with law.
