In this Petition, the Petitioners challenge the judgment and order dated 30 July 2016 passed by the District Judge 2, Raigad, Alibag in Civil Misc. Appeal No. 98 of 2007. In the said Appeal, the Petitioners had challenged the order dated 28 November 2007 passed by the Trial Court rejecting application for temporary injunction.

The present Petition is pending since the year 2016. Considering the fact that the application for grant of temporary injunction was rejected by the Trial Court on 28 November 2007 and that there has been no injunction in favour of the Petitioners during last 16 long years, no purpose would be served by deciding the merits of the present Petition.

Mr. Joshi, learned counsel for the Petitioners, submits that the

15-WP-443-2018 Suit is pending at the stage of evidence and requests for a direction to the Trial Court for early disposal of the Suit. I am not aware about the pendency of the cases before the Trial Court and, therefore, it would not be possible to direct expeditious hearing of the Suit. Considering the fact that the Suit has been pending since the year 2007, I am sure that the Trial Court would give due priority for disposal of the Suit considering the pendency of cases before it. 4.
