The petitioner/applicant is convict in jail has sent letters for reduction in his punishment. In earlier letter, he has mentioned that he is in Nashik Road Central Prison. Learned APP however, submits that in one of the letters, present petitioner states that he is lodged in Yerwada Prison. It appears from the letter that Sessions Court at Palghar has convicted him under section 302 of the Indian Penal Code on 13/10/2008. Talwalkar

6.appw1250.15.510.17.doc It is not clear whether this prisoner has filed any appeal challenging the conviction.

As he is still in prison, we direct the concerned jailer to provide necessary legal assistance to prisoner so as to enable him to prefer an appeal under section 374 of the Code of Criminal Procedure, 1973 challenging his conviction. The necessary legal aid be extended within four weeks from today. Proceedings disposed of.
