By this application the applicant has sought to implead PW 1 and PW 3 in Session Case No. 180 of 2012 as respondent No. 2 and respondent No. 3 respectively in the present appeal. 2.

Heard learned counsel for the applicant and learned APP for the State.

The Criminal Appeal arises from the judgment and order dated 6th February, 2012 in Sessions Case No. 180 of 2012 whereby the applicant herein has been convicted for offence under section 363 of Indian Penal Code.

The P.W. 1 and P.W. 3, who are sought to be impleaded in the 1/2

49-APPA-1490-16 appeal as respondent Nos. 2 and 3 are in fact victim and the father of the victim. The presence of PW 1 and PW 3 not required for deciding the appeal.
