On account of an objection being raised by the learned counsel for the Respondent about this Court entertaining the Petition under Section 29-A, since the Sole Arbitrator was not not nominated by this Court, but it was appointed by the consent of the parties and, therefore, an appropriate application will have to be preferred before the District Judge in Thane, the learned counsel for the Petitioner concede to the position and seek permission to withdraw the present proceedings.

He, however, reserves the liberty to approach the Principal District Judge, Thane for claiming the relief, which is M.M.Salgaonkar

2/2 32 ARP-26-24.odt prayed in the present proceedings i.e. for extending the mandate of the Arbitral Tribunal.

The Petition is permitted to be withdrawn and stands disposed off, as withdrawn, by reserving the liberty as prayed for.

Needless to state that if the issue arises as to the substitution of the Arbitrator, while the mandate being extended, the same is also permitted to be agitated in the same proceedings.
