This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.479 of 2022 registered at Yavat Police Station, Pune for the ofences punishable under Sections 302, 201, 120(b) read with 34 the Indian Penal Code (IPC).

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The deceased was the husband of applicant. According to the prosecution, the deceased was addicted to liquor and used to assault the present applicant and their son and thus he with his friend committed the murder of deceased and with a view to cause disappearance of evidence, they threw his dead body in jungle. According to the prosecution, though the present applicant Dinesh S. Sherla 1/2

26-ba-3305-22.doc was aware about the alleged crime, she lodged the missing report. 5.

The allegations in relation to murder of the deceased are against the son of applicant, who is juvenile and his friend. Considering this fact, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in C.R. No.479 of 2022 registered at Yavat Police Station, Pune for the ofences punishable under Sections 302, 201, 120(b) read with 34 the Indian Penal Code (IPC) on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
