Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail. The applicant, who is implicated as accused no. 2, is apprehending arrest in connection with C.R. No. 101 of 2022 registered with Tilak Nagar Police Station, Dombivali for the offence punishable under sections 368, 384, 34 of the Indian Penal Code, 1860.

The applicant is the wife of accused no.1-Ajaykumar
Jadhav. The FIR is lodged by the complainant on 17/07/2022. It is alleged that the accused no. 1 and accused no.2 committed the offence. There were some monetary transactions between the complainant and the accused no.1 -Ajaykumar Jadhav. On 05/04/2022, a complaint was made by Ajaykumar Jadhav against the complainant regarding two cheques issued which came to be dishonoured. It is Ajaykumar Jadhav's case that because the complainant does not want to repay the loan, present complaint is filed.

Having gone through the allegations, though the applicant has been named in the FIR, regard being had to the nature of the allegations, the matter is mainly between the accused no. 1- Ajaykumar Jadhav and the complainant. The applicant is wife of accused no.1. Ajaykumar Jadhav was already arrested and since has been granted bail. Apart from the merits of the matter, even the custodial interrogation of the applicant who is the wife of the original accused no. 1 is not required in the present case. The applicant's role is not such that her custody is required.
There are no criminal antecedents against the applicant. Hence, the following order. Hence, the following order.
O R D E R
(a) In the event of arrest of the applicant in connection with C.R. No. 101/2022 registered with Tilak Nagar Police Station, Dombivali, the applicant- Smt. Aparna Ajaykumar Jadhav be released on bail on her furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;
(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence;
(c) The applicant shall report to the Investigating Officer of the concerned Police Station as and when required.
