} Petitioners versus Shri Hanumant Dada Jadhav and Ors.
} Respondents Mr. Dilip Bodake for the Petitioners.
Mr. Vishwanath S. Talkute for Respondent Nos. 1 to 4. CORAM :- S.C.DHARMADHIKARI, J.
DATED :- AUGUST 7, 2015 P.C. :- (Chamber) Heard parties on the Review Petition forthwith. After having perused the Review Petition and the order passed admitting the Second Appeal so also on the Civil Application for interim relief, the review of which is sought, I am of the view that there is no necessity of modifying the order. The Court was not inclined to grant any interim relief but as already clarified that any alienation prior or subsequent to the admission of the Second Appeal has to abide by the outcome of the Second Appeal. Therefore, in the event the Appellants/Applicants to this Review Petition succeed in the Second Appeal and the Decree of the Trial Court is maintained or modified, then, all consequences in law shall follow. Thereafter that decree and order can be enforced and in J.V.Salunke,PA
RPST.33225.2014.2.doc accordance with law. In such circumstances, there is no need to review or modify, leave alone recall the order passed in Civil Application No.502 of 2011 on 7th January, 2014. The Review Petition is therefore entirely misconceived and is dismissed. No costs. (S.C.DHARMADHIKARI, J.) J.V.Salunke,PA
