Mr.Walimbe, learned AGP tendered a copy of the letter dated 21st September, 2021 addressed by the Education Officer (Secondary), Zilla Parishad, Thane to the learned AGP issuing various instructions regarding appointment of the petitioner as Junior Clerk. A copy of the said letter is taken on record and marked "X" for identification.

Mr.Thomas, learned counsel appearing for the petitioner on instruction states that in view of the statement made in the letter dated 21st September, 2021 by the Education Officer (Secondary), 1/3

the petitioner will make a formal request to the Education Officer (Secondary) to communicate the names of the schools having vacant post of Junior Clerk in the vicinity of Thane within one week from today. Upon receipt of the said letter from the petitioner, the Education Officer (Secondary) will identify those schools having such vacant post within two weeks thereafter. The petitioner thereafter would identify one school out of the said list in which the petitioner is ready and willing to accept the said post of Junior Clerk within one week thereafter. The Education Officer (Secondary) shall issue order of appointment in respect of the said school on such post within one week thereafter.

It is made clear that till the petitioner is accommodated in the school having such vacant post, which is offered by the said letter dated 21st September, 2021, the petitioner would continue on the existing post occupied by the petitioner.

It is made clear that since the petitioner was already working on the permanent post and was declared as surplus, the post that would be offered to the petitioner by the Education Officer (Secondary) would be also on permanent basis. 5.

The writ petition is disposed of in aforesaid terms. Adinterim protection granted by this Court to continue till the petitioner is accommodated in the school having vacant post of Junior Clerk. 2/3

Upon the petitioner having absorbed on the said post, status-quo order passed by this Court to stand vacated.
