DATED : 16 JANUARY 2023 P.C. :- This is an application under Section 438 of the Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No. 241 of 2022 registered at Pimpalgaon police station for the offences punishable under Sections 376 read with 34 of the Indian Penal Code and Section 4, 8, 9, 11 and 12 of Protection of Children from Sexual Offences Act. 3.

The learned counsel for the applicant and the learned counsel for respondent No. 2 submit that on 21 April 2022 the victim after attaining majority had married to the applicant.

Considering the above fact, I am inclined to release the applicant on anticipatory bail. Hence, the following order is passed; (i) Application is allowed.

(ii) In the event of arrest of the applicant in Crime No. 241 of 2022 registered at Pimpalgaon police station for the offences punishable under Sections 376 read with 34 of the Indian Penal Code and Section 4, 8, 9, 11 and 12 of Protection of Children from Sexual Offences Act, he shall be released on bail on furnishing PR bond in the sum of Rs. 15,000/- with one surety in the like amount.
