Though the Respondents are duly served, no one appeared on behalf of them when the matter called out. By this Writ Petition, the Petitioner-original Plaintiff is challenging the order passed by the trial Court rejecting their application below Exhibit 41 in Special Civil Suit No. 241 of 2014.

During the course of argument, the learned counsel for the Petitioner submits that in view of the subsequent development, nothing survives in the Petition and therefore the Petitioner may be permitted to withdraw the Writ Petition. He further submits that the Petitioner being a senior citizen, the hearing of suit may be expedited. To that effect, he has given in Vishal Parekar 1/2
