Learned Counsel for the Petitioner, on instructions from the Petitioner who is present in Court, states that the Petitioner shall not part with or create third party rights in respect of Gala Nos. 2 and 3, Shed-A, Radheshyam Industrial Estate, Aasan Gaon, Taluka-Sahapur, DistrictThane, till the loan account of the Respondent No.4 is settled. 2.

In view of above statement, the learned Counsel for the Respondent No.3-Bank states that in the event the Respondent No.3-Bank propose to attach the aforesaid Galas, they would give three weeks' prior notice to the Petitioner.

Learned Counsel for the Respondents Nos.4 and 5 states that the Respondent No.4-Company shall, within three weeks from today, submit a One Time Settlement Proposal in accordance with the scheme of the Respondent No.3-Bank. If such proposal is made within 3 weeks, the same shall be decided by the Respondent No.3-Bank expeditiously. 4.

We accept the statements made by the learned Counsel as recorded above and dispose of the Petition. There shall be no order as to costs.
