After this matter was heard for some time, on instructions, Mr. Kantawala states that the petitioner will not press this petition, but reserve his liberty to present a bail application to the competent criminal court and seek release on bail on such terms as are deemed fit and proper by that court. His only request is, given that the petitioner is in custody, his right to life and liberty guaranteed by Article 21 of the Constitution of India is at stake. If such a bail application is presented on or before 4th December, 2017, that bail application be heard and the requisite orders be passed before 12th December, 2017.

The present writ petition is disposed of with liberty as prayed.

We clarify that despite the extensive arguments, notes being tendered and affidavits being filed, we have not expressed any opinion on the rival contentions and particularly about the petitioner's detention. However, we direct that in the event such bail application is filed on or before 4th December, 2017, the same should be disposed of with requisite orders before 12th December, 2017.
