1.
The Family Court has decided three petitions between the parties by judgment and order dated 02nd April 2019. Admittedly, the parties have challenged the said judgment in FCA Stamp No.24833, 24836 of 2019 which are pending before this Court. There is also an application for condonation of delay being FCA Stamp No.24834 of 2019.
2.
The petitioner has filed an application for review of the judgment and order passed by the Family Court on 13th August 2019 which is pending before the Family Court. The Family Court by the N.S. Kamble page 1 of 2
906-wp-130-2020 impugned order dated 13th August 2019 has kept the review petition pending till further orders of this Court in the two Family Court Appeal.
3.
The only limited contention on behalf of the petitioner is that this Court may direct that the Review Application may be heard on its own merits notwithstanding the pendency of the Family Court appeal. In my considered view it would be improper for this Court to grant any such clarification when the two Family Court Appeals are pending before the Co-ordinate Bench of this Court. The remedy of the petition, if any, for such clarification lies elsewhere. The petition is disposed of in the aforesaid terms. 4.
Rival contentions are left open.
