By an order dated 23.11.2017 the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates.

Perused the record of investigation. The record indicates that in furtherance of the directions issued by this Court the applicant has attended the Investigating officer and the recovery of weapons i.e. sticks have been effected at his instance under Section-27 of the Evidence Act. The custody of the applicant was sought by the Investigating agency for recovery of the said weapons which were alleged to have been used by the applicant in the present crime.

In view thereof, the interim relief granted by an order dated 23.11.2017 is confirmed.

However, the applicant is directed to attend the Investigating Officer as and when called for between 10.00 a.m. to 2.00 p.m. till filing of charge sheet. 4.

Application is allowed in the aforesaid terms. (A.S.GADKARI, J.)
