The learned counsel appearing for the third and fourth respondents, on instructions from Shri Sanjay Bhole, Town Planner, KDMC, states that the Municipal Corporation has withdrawn the letter dated 24th August 2017 (Exh.T to the petition). 4.

We accept the said statement. In view of the statement, the petition need not be kept pending and we pass the following order: (i) As the impugned communication dated 24th August 2017 stands withdrawn, the application for development permission made by the petitioner, if pending, shall be

skn 450.18-wp decided by the Municipal Corporation as expeditiously as possible and, in any event, within a period of six weeks from today in the light of order dated 7th April 2015 passed in Writ Petition No.8005/2012 without insisting upon publication of gazette notification under sub-section (2) of section 127 of the Maharashtra Regional and Town Planning Act, 1966. (ii) Petition stands disposed of in the above terms. (iii) All concerned to act upon an authenticated copy of this order.
