CORAM : RANJIT MORE & SMT.ANUJA PRABHUDESSAI, JJ.
DATE : 18th DECEMBER, 2017.
P. C. :
The petition is filed challenging the demand notice under Section 150 of the Maharashtra Municipal Councils (Nagar Panchayats and Industrial Townships) Act, 1965 (for short "the said Act"). The learned counsel for the petitioners does not dispute that such notice can be challenged by filing an appeal before the learned Magistrate or Committee under the said Act. Be that as it may, the impugned notice is issued in the 2nd week of March-2017 and the present petition is filed in November-2017.
2.
In the above circumstances, it is clear that the petitioners have an efficacious alternative remedy. We are, therefore, not inclined to entertain this petition in exercise of jurisdiction conferred upon this Court under Article 226 of the Constitution of India and the same is, accordingly, dismissed.
