Heard Mr.Mahesh Mishra, learned Counsel for the applicant.

By this application, the applicant/plaintiff has prayed for issuing direction to the Registry to send back R & P to the office of the Appellate Bench of the Small Causes Court at Bandra for correcting the title of Appeal No.16/2004 as also correcting the judgment and decree dated 9.11.2010 passed in that appeal and returning the record to this office after carrying out the corrections.

Mr. Mishra invited my attention to the judgment of the trial Court wherein defendant No.3 is 'Usha B. Solanki'. He also invited my attention to the judgment dated 9.11.2010 passed by the Appellate Court where inadvertently appellant No.3/defendant No.3 is described as 'Umesh B.

In view thereof, office is directed to transmit the R & P to the Appellate Bench of Small Causes Court at Bandra, Mumbai to carry out necessary corrections in the title of Appeal No.16/2004 as also the cause title of the judgment dt. 9.11.2010 passed in said appeal. After carrying out necessary corrections, the Appellate Bench shall forthwith transmit original R & P to this Court.
