Mr. Deshmukh, the learned Counsel for Respondent no.1 on instructions states that the order impugned in the present petition is withdrawn and a fresh order will be passed after giving an opportunity of being heard to the Petitioner. 2.

In that view of the matter, nothing survives in the petition and the same is disposed of.

We further clarify that we have not considered the merit of the matter and all the issues are kept open to the rival parties. We further direct that the fresh proceeding be concluded within six weeks from today.
