This is an application for modification of condition of the bail granted to the applicant vide order dated 29th August 2017 passed by this Court in Criminal Bail application No. 1484 of 2017.

During the course of hearing the learned advocate for the applicant submitted that he is not pressing prayer clause 'a' but as the applicant could not arrange sureties, he being Kavita Page 1 of 3

resident of Tamilnadu State, for a period of 8 weeks he may be released on furnishing cash security.

The learned APP opposed the application.

I have considered the rival submissions. It is seen that the present applicant is resident of Coimbatore in Tamilnadu. He is directed to be released on bail on executing P.R bond in the sum of Rs.30,000/- with one or two sureties in the like amount. The applicant is not in a position to furnish sureties unless and until he comes out of the prison and therefore despite directing his release on bail vide order dated 29th August 2017, he continued to be undergoing pre-trial detention. In this view of the mater, the following order.

ORDER

i) For the period of eight weeks, the applicant/accused be released on bail on furnishing cash security of Rs.30,000/-. By the end of this period of 8 weeks, the applicant to produce Kavita Page 2 of 3

sureties as directed vide order 29th August 2017 in bail application No.1484 of 2017.
