Learned counsel appearing appearing for the petitioner seeks liberty to withdraw this writ petition with liberty to file an Appeal under section 35(1-A) of The Maharashtra Slum Areas (Improvement, Clearance & Redevelopment) Act, 1971. The appeal shall be filed within two weeks from today and a copy thereof shall be served upon the contesting respondents simultaneously. It is made clear that no further extension of time would be granted.

The writ petition is dismissed as withdrawn with liberty as prayed. It is made clear that this Court has not expressed any views on the merits of the matter. All the contentions of both the parties are kept open.
