P.C.:- By a well reasoned order dated 31st October, 2018, the Applicant was granted interim relief and was directed to attend the Investigation Officer on stipulated dates.
Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record of investigation. As noted in the Order dated 31st October, 2018, it is the co-accused Nandu who is the main assailant of the first informant. The record, prima facie, indicates that, there is a variance in two medical certificates issued by two different hospitals. The record 1/2
ssm 2 20-aba2264.18.doc further reveals that, the Applicant as per Order dated 31st October, 2018, has attended the Investigating Officer and has joined the process of investigation.
After taking into consideration the record of investigation made available before this Court, this Court is of the view that the custodial interrogation of the Applicant for further investigation of the present crime is not necessary.
The interim relief granted by Order dated 31st October, 2018 is hereby confirmed.
However, the Applicant is directed to attend the concerned Investigating Officer as and when called for between 10.00 a.m. to 2.00 p.m. and to join the process of investigation till submission of final report.
