Heard rival submissions on this application for condonation of delay of 4 days in filing the appeal challenging the acquittal of the respondents in the matter of offences punishable under sections 447 and 448 read with section 34 of Indian Penal Code.

The learned counsel for the respondent objected for condonation of delay on the ground that there is no apparent reason to grant even delay of 4 days. For the reasons mentioned in para no.3 of the application as to taking time to N.S. Kamble page 1 of 2

The learned counsel for respondent no.1 stated that till date he has received instructions only from respondent no.1 and that also for the application for condonation of delay. Respondent No.2 is the wife of respondent no.1. The learned counsel to take instructions as to whether he can appear for both the respondents. The applicant to serve learned counsel for respondent no.1 with copy of the leave application along with other documents. Respondent nos.1 and 2 to waive service of the application for leave.
