The above Petition is companion to Writ Petition No.11531 of 2015. By virtue of the order passed today in the said Writ Petition No.11531 of 2015 whereby the impugned order dated 19/06/2014 is set aside and the Appeal in question is remanded back to the Lower Appellate Court, the above Writ Petition challenging the said order albeit on a different ground has turned infructuous and is accordingly disposed of as having turned infructuous. The learned Senior Counsel for the Petitioner Shri Jahagirdar as also the learned counsel appearing of the Respondent Nos.1 and 2 Shri Mohan Pungliya assure this Court that no unnecessary adjournments would be sought and they would cooperate in the disposal of the Misc. Civil Appeal No.20 of

2014 in terms of the time frame fixed by this Court in the order passed today in Writ Petition No.11531 of 2014. All the contentions of the parties are kept open for being agitated before the Lower Appellate Court. [R.M.SAVANT, J]
